Agreement
By accessing or using Icarus ("the Platform"), operated by Rego AI, Inc. ("Rego"), you agree to these Terms of Service. If you do not agree, do not use the Platform.
Services
Icarus provides ICHRA administration software including plan design tools, employee portals, claims management, reimbursement processing, compliance documentation, and marketplace plan comparison. The Platform is a technology service — we are not an insurance carrier, broker, or licensed medical provider.
Accounts
You are responsible for maintaining the confidentiality of your account credentials. Employer administrators are responsible for the accuracy of employee data entered into the Platform. You must notify us immediately of any unauthorized access.
Employer Responsibilities
- Ensure ICHRA plan design complies with applicable IRS and DOL regulations
- Fund reimbursements in accordance with the plan document
- Distribute required notices to employees within regulatory timeframes
- Maintain accurate employee census data
While Icarus provides compliance tools and documentation templates, employers retain ultimate responsibility for their ICHRA plan's legal compliance. We recommend consulting with benefits counsel.
Employee Use
Employees access the Platform through employer-sponsored accounts. Health profile data is voluntary and used solely for plan matching. Claims submitted must be for qualifying medical expenses under IRC Section 213(d).
AI-Assisted Features
Icarus uses artificial intelligence for plan matching, claims review recommendations, and receipt analysis. AI features are informational only — they do not constitute medical advice, insurance recommendations, or final claim decisions. Human administrators make all approval and denial decisions.
Payment Processing
Reimbursement payments are processed through our banking partner. Rego is not a bank or money transmitter. Funds are held and disbursed by licensed financial institutions.
Marketplace Data
Plan data displayed in the Platform is sourced from CMS (Healthcare.gov) and may not include all available plans in all states. Plan details, premiums, and benefits are provided for informational purposes and may vary. Always verify plan details directly with the insurance carrier.
Limitation of Liability
Rego provides the Platform "as is." We are not liable for insurance coverage decisions, claim denials by carriers, marketplace data inaccuracies, or employer plan design choices. Our liability is limited to the fees paid for the Platform in the 12 months preceding any claim.
Termination
Either party may terminate service with 30 days written notice. Upon termination, employer data will be available for export for 90 days. After 90 days, data is deleted in accordance with our retention policy.
Governing Law
These terms are governed by the laws of the State of Utah. Disputes will be resolved through binding arbitration in Salt Lake County, Utah.
